The prosecution is just beginning its SECOND closing argument in the #BettyShelby case. @NewsOn6
DA Steve Kunzweiler asked the jury to make decision "free from sympathy, bias, prejudice" and base it ONLY on evidence from courtroom.
5 heat of passion elements: death, caused by defendant, not justifiable, inflicted by dangerous weapon, defendant was in heat of passion.
Kunzweiler says they have to prove ALL 5 of those are true--he believes the prosecution has done that.
Kunzweiler said Crutcher's hands were in the air--was his arm really reaching inside car, or what he just trying to put hands on car?
Kunzweiler says Crutcher was never aggressive toward Officer Shelby--plus, no DNA from his arm was found on the top of the window.
The theme of his argument was: WHY? He told the jury to ask themselves the reasons WHY things happened the way they did.
Kunzweiler: Why did Officer Tyler Turnbough tell her to holster her weapon (when there was still a threat present)?
Kunzweiler: WHY did Corporal Wyett Poth tell her "not to say a word"? Kunzweiler says bc ALL officers knew it was a bad shoot immediately.
Kunzweiler brings up DRE pop quiz debacle--says that's the only time that instructor has ever had a student behave that way. "Meltdown."
Kunzweiler discredited the defense's expert witnesses. Said they were all either former cops or had always worked closely with cops.

Defense's Shannon McMurray began her closing by quoting MLK, Jr. She glared into the audience when someone from Crutcher side laughed.
McMurray said TPD has investigated every single officer involved shooting except this one, not the DA.
McMurray said the DA chose Doug Campbell to investigate over Jeff Felton, who had much more experience in officer involved shootings.
